Historic Tours of America®, Inc., Old Town Trolley Tours and our affiliated companies (collectively referred to as “Historic Tours”, “Historic Tours eTicket Center”, “us,” “we,” or “our”) operate the tours, attractions, and other services (our “Services”) described at our family of websites listed below (our “Websites” or individually a “Website” or “site”). The term “you” refers to the user or viewer of our Websites.
By using this site, you (and anyone who uses Services purchased by you on this site, collectively termed “you”) agree to comply with and be bound by this Website Terms of Use Agreement (“Terms of Use”). If you do not accept these Terms of Use, you are not authorized to use this site. We reserve the right to change these Terms of Use from time to time, and your continued use of this site constitutes your acceptance of and agreement with any such changes. You must be eighteen (18) years of age or older (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age) in order to use this site or purchase any Services hereunder.
The Historic Tours of America® Privacy Policy, as updated by us from time to time, is incorporated into and is part of these Terms of Use. Please review our Privacy Policy, which describes our practices for collecting, using, and sharing information, including information collected when we provide the Services and on our Websites.

If you are dissatisfied with the tour and attraction services purchased from this site that are directly owned and operated by Historic Tours, we will refund your purchase price upon notification in writing using the links found in the refund section below.
DATE OR TIME SPECIFIC TICKETS ARE NON-REFUNDABLE
Due to limited seating availability, date and/or time specific tickets are non-refundable if they are not used on the reservation date (no show). You may reschedule your date/time up to twenty-four (24) hours in advance of the tour/trip time under the “Rescheduling” terms below. If we cancel your tour/trip due to inclement weather, equipment breakdown, civil order, or other force majeure event we offer guests a choice of a refund or rescheduling to a future date. THE COVID 19 PANDEMIC OR OTHER SIMILAR PANDEMIC OR EPIDEMIC SHALL NOT BE CONSIDERED A FORCE MAJEURE EVENT. IN THE EVENT OF ANY CANCELLATION OF SERVICES DUE TO COVID-19 RESTRICTIONS, OUR STANDARD RESCHEDULING POLICY BELOW WILL APPLY.
RESCHEDULING
For guests that have purchased tickets directly from our Website we offer a “Modify Booking Tool” located at (https://www.trolleytours.com/manage). Guests may change their reservation one-time at no charge*. However, the guest is fully responsible if the fare price for the new date/time selected is more expensive. Refunds are not issued where ticket prices have decreased due to promotions or where the date/time selected is less expensive. Changes are subject to availability.
*Additional Changes – If you made changes previously and need to modify your tour or attraction date/time again, please contact the Tour or Attraction by phone.
If you purchased your tour or attraction product at one of our local sales depot locations, please contact the local operation directly to make any itinerary changes. The change policies of the local sales depot location will apply. If you purchased the tour or attraction product from Trusted Tours & Attractions or a third-party online travel agency (Viator, Expedia, Get Your Guide, Trip Advisor etc.) please contact those parties directly to make any changes. The change policies of those parties will apply.
UNUSED FLEX TICKETS ARE NON-REFUNDABLE
Unused Flex Tickets (tickets without a specific date/time) are non-refundable and are non-transferable; they remain valid for use for twelve (12) months from the date of purchase.
THIRD-PARTY TOUR AND ATTRACTION TICKETS ARE NON-REFUNDABLE
Certain products and services sold on our site are owned and operated by third parties. These products are identified as third-party products on the tickets associated with their sale. We have no responsibility or liability for those products or services. Our refund policy applies only to tours and attractions that are owned and operated by Historic Tours.
PROMOTIONAL TICKETS ARE NON-REFUNDABLE (FREE, ADD-ON, OR VIP TICKETS)
Promotional tickets may be used at any time within the twelve (12) months following the date of purchase. Free or promotional “Add-On’s” tickets have no monetary value and are therefore non-refundable.
DISCOUNTED PACKAGES
If you have purchased a discounted tour or attraction package containing two or more products and were dissatisfied with one of the products, we will refund that portion of the package at the discounted attraction rate under our 100% Satisfaction Guarantee.
TRANSACTION FEES
If you decide to purchase tickets or other items, you agree to pay, in addition to the price for the ticket or item, other fees and charges that we impose, such as state sales tax, franchise fees, or city fees. The amount of each fee will vary, depending on the tickets or items you purchase.
Fees and charges, including (but not limited to) charges for issuance, convenience, handling, processing, shipping, delivery, franchise fees, city fees, and any other miscellaneous charges assessed by us represent, among other things, the costs we incur in providing our goods and services to you. The fees and charges we assess may be greater than our actual cost of providing those services, and we may retain a portion of all such fees and charges as profit.
You are urged to review all pages displayed during your completion of a purchase. If you do not agree to pay the fees or charges associated with your purchase, you may cancel your transaction.

IF YOUR TICKETS WERE PURCHASED FROM A THIRD-PARTY BOOKING SITE OR VOUCHER COMPANY (SUCH AS VIATOR, EXPEDIA, GET YOUR GUIDE, TRIP ADVISOR, ETC.) THE REFUND POLICY OF SUCH THIRD PARTY BOOKING SITE OR VOUCHER COMPANY WILL APPLY.
Proof of Purchase (showing the purchase date and price) is required for refund processing. Credit for all returns will be in the same manner as original payment.
ASSUMPTION OF RISK/INDEMNIFICATION AND COVID 19
While we try to utilize reputable providers with what appear to be good safety practices, all we do is determine if the tour experience is enjoyable; we do not provide in-depth safety or risk analysis of these Services, nor are we qualified to perform such analysis. When you purchase Services from us, you are acknowledging and assuming all risks associated with participation in any or all of the activities associated with such Services.
While tour and attraction companies are taking enhanced safety and health measures for the benefit of their customers, inherent risks associated with COVID-19 exist in any place where people are gathered. By accessing or using any Services, you voluntarily assume all risks arising out of or resulting from exposure to COVID-19 or any other communicable illness.
In addition, by purchasing or participating in activities which are part of the Services, regardless of the place of purchase, you agree to abide by any and all of the terms and conditions imposed by any provider of any activity which is part of any Services. Some activities have inherently more risk than others, and while we have confirmed that the providers of Services represented through this site provide an enjoyable, satisfying experience, we cannot guarantee your safety or be responsible for any damages suffered by you as a result of participating in any Services. The individual providers of Services are solely responsible for all liability associated with any Services provided to you.
Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. PERSONAL INFORMATION WE COLLECT
We use the term “personal information” in this Privacy Policy to refer to information that identifies, relates to, describes, or is reasonably capable of being associated or linked, directly or indirectly, to you. Personal information does not include information that has been modified in a substantial way so can no longer can reasonably be used to identify or be linked to you.
Personal Identifiers. When you book a reservation, purchase a ticket, take a tour, visit an attraction, or sign up for our E-Newsletter we may ask you, as an individual customer or family or group leader, to provide us with personal identifiers that can be used to contact or identify you. These may include, but are not limited to:
- First name and last name
- Email address
- Phone number
- Full or partial postal address
Credit Card and Payment Data. For online purchases, your credit card number and CVV are directed to third-party services for payment processing (e.g. payment processors) and are not collected or stored in our systems. For in-person purchases at our tours and attractions, your credit card information is collected by the operator and transmitted to a payment processor. Historic Tours of America®, retains the last four digits of your credit card number for documentation purposes, and we may retain your billing address and phone number for purposes of our fraud prevention program.
Booking Information and Special Accommodations. When you make a reservation or purchase a ticket for our tours and attractions, we ask for the name of the family or group leader, email address, zip code, and other booking information such as name of the tour you selected, location, date, and time, and the number of adults and children in your group. Some of our tours and attractions offer special accommodations for wheelchairs and other assistive devices. To provide those accommodations, we will ask for basic information about your needs to fulfill your request.
Information Provided by Independent Operators. We obtain booking information (as described above) from independent companies who work with us to book our tours and attractions and may offer additional attractions that enhance our Services. They may refer you to our Services or make a reservation on your behalf. They include, for example, hotel concierges, travel agents, and independent operators of attractions that are not affiliated with Historic Tours of America®.
Experience History and Hometown Pass. It is our practice to retain personal information about the tours and attractions our customers’ have experienced for future marketing purposes and to build a long-term relationship with you. We also retain the name, contact information and transaction history of our Hometown Pass users.

HOW WE SHARE PERSONAL INFORMATION
Historic Tours of America® does not sell the personal information of our customers or others. We may share personal information for business purposes with the following categories of third parties.
Companies in our Historic Tours of America® Family. We share our customers’ personal information with our parent company, Historic Tours and Attractions, Inc., and other affiliated companies for any of the purposes outlined in this Privacy Policy. Our affiliated companies may use your personal information for marketing and other commercial purposes. Our affiliated companies are listed below.
Third-Party Ticket Sellers. We partner with hotel concierges and travel agents to sell tickets to our tours and attractions. They provide personal information to us and in order to process the reservation or ticket sale we may share personal information with them.
Independent Operators: If we facilitate a reservation for you with an independent tour or attraction operator, we may share your booking and other personal information with the operator and we may receive a transaction fee. The shared information is used to book the reservation and so the operator can verify the identity of the ticket holder when the ticket is presented onsite. Personal information shared in this way includes the first and last name of the family or group leader purchasing the tickets, the number and type of tickets purchased, the date and time of any reservations as applicable, the date the ticket was purchased, and the individual or leader’s email address and/or phone number if the tour needs to contact you about changes such as cancellations. These tour and attraction operators may use your personal information for their own marketing and other commercial purposes.
Payment Processors. We engage payment processors to process ticket sales on our behalf. They adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of payment card issuing brands such as Visa, MasterCard, American Express, and Discover.
Service Providers. We engage service providers and use cloud software services to assist with marketing, administrative, technology and data processing functions on our behalf. Right to Deletion of Personal Information
California consumers have the right to request that Historic Tours of America® delete any personal information about the consumer which Historic Tours of America® has collected from you, subject to a range of exclusions permitted by law (“Right to Delete”). For example, Historic Tours of America® is not required to delete personal information if it is necessary to complete a transaction, reasonably used for an ongoing business relationship, or used internally in a lawful manner that is compatible with the context in which the consumer provided the information.

Right to Designate an Authorized Agent

How We Will Respond to a California Consumer Request
We will confirm receipt of a Right to Know or Right to Delete request within 10 days and may request additional information necessary to verify that you are permitted to make the request. We will respond to a verifiable consumer request within 45 days of receiving it, subject to delays and exclusions permitted by law. If we require more time to respond, we will let you know the reason why and an extension period in writing. If you have a password-protected online account with us we will respond via account. If you do not have an online account, please provide either your email address or U.S. Postal address, at your option.
For a Right to Know request, our response will cover the 12 month period preceding our receipt of the request. If we cannot comply with all or part of your request, we will explain the reasons why. For data portability requests, we will select a format to provide your personal information that is usable and should allow you to transmit the information readily from one entity to another entity.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Protection from Discrimination for Exercising California Consumer Rights
We will not discriminate against a California consumer for exercising any of the rights described in this section. This means that except as legally permitted we will not:
